Our commercial legal expenses insurance policy wording is changing.

Key changes to the policy wording effective from 3 April 2025

This is a summary of key changes from the previous policy document versions. 

Insurer

This insurance is underwritten by ARAG Legal Expenses Insurance Company Limited ("ARAG").

Debt recovery

Debt recovery is still covered but applies for outstanding debt over £500.

Tenancy disputes

This insurance now covers a civil dispute between you and your landlord relating to premises leased or rented by you.

Property protection

This insurance now covers costs and expenses for:

A civil dispute relating to physical property which is owned by you, or is your responsibility following:

  1. any event which causes physical damage to such physical property; or
  2. a legal nuisance; or
  3. a trespass.

Contract disputes

Contract disputes are still covered but the level of cover has changed to:

A contractual dispute arising from an agreement or an alleged agreement which has been entered into by you or on your behalf for the purchase, hire, sale or provision of goods or of services.

Provided that:

(a) the amount in dispute exceeds £500 (incl VAT)

(b) if the amount in dispute exceeds £5,000 (incl VAT), you must pay the first £500 of any claim.

Jury service and court attendance

This insurance now covers the Insured’s absence from work:

(a) to perform jury service

(b) to attend any court or tribunal at the request of the appointed representative in relation to a claim that is an insured incident under this policy.

The maximum we will pay is the insured person’s net salary or wages for the time that they are absent from work less any amount you, the court or tribunal, have paid them.

Employment disputes and compensation awards

This insurance now covers:

1. Employment disputes 

Costs and expenses to defend your legal rights:

(a) before the issue of legal proceedings in a court or tribunal:

 (i) following the dismissal of an employee; or

 (ii) where an employee or ex-employee has contacted

ACAS (‘Advisory, Conciliation and Arbitration Service’) to commence the Early Conciliation procedure; or

(b) in unfair dismissal disputes under the ACAS Arbitration Scheme; or

(c) in legal proceedings in respect of any dispute relating to:

 (i) a contract of employment with you; or

 (ii) an alleged breach of the statutory rights of an employee, ex-employee or prospective employee under employment legislation.

2 Compensation awards

In respect of a claim we have accepted under insured incident 1 Employment disputes we will pay:

(a) any basic and compensatory award; and/or

(b) an order for compensation or damages following a breach of your statutory duties under employment legislation.

Crisis communication

This cover is no longer available under this insurance.

What is this type of insurance?

Business Legal Protect protects you and your business from IR35 investigations, HMRC disputes, criminal prosecutions, negative PR and identity theft. It also helps with bed debt recovery and offers free tax, legal and counselling assistance whenever you need it.

What is insured—significant features and benefits

✔ Up to £100,000 in legal expenses and accountant fees; including the cost of appeals in respect of:

  • Tax disputes;
  • Criminal investigations;
  • Compliance & regulation investigations and claims;
  • Personal identity theft;
  • Contract & debt recovery (invoices over £200);
  • Significant adverse publicity or reputational damage (up to £25,000).

✔ Free tax and legal advice; relating to your business. Legal advice is available on matters within UK and EU law and tax matters within the UK.

✔ Free crisis communication assistance; professional public relations support to assist you with handling a negative publicity event.

✔ Free counselling; qualified counsellors will provide free confidential support and advice by phone to you, your employees or their family members.

✔ Free legal template builder; access to an online legal guide and custom document builder.

What is not insured—significant or unusual exclusions or limitations

✗ Legal costs & expenses not agreed in advance by the insurer.

✗ Claims arising from failure to follow HMRC rules or from tax avoidance schemes.

✗ Any actual or alleged act, omission or dispute happening before, or existing at the start of the insurance.

✗ Claims arising out of illegal, unlawful, violent or antisocial behaviour.

✗ The payment of fines, penalties or compensation awards.

Where am I covered?

Your legal defence and contract & debt recovery claims are covered in the United Kingdom, Channel Islands, Isle of Man, Norway, Switzerland and countries in the European Union. Any other claims are covered within the United Kingdom, the Channel Islands and the Isle of Man.

What are my obligations?

The premium and insurance cover is based on the details you have provided to us. Please make sure the information is complete and accurate. You must inform us immediately of any changes in your or your business circumstances that may affect our ability to provide this cover. This obligation applies at all times - before applying for coverage and throughout its life.

If you fail to disclose any information which is material to this insurance you could invalidate the policy and claims may not be paid.

If you need to make a claim, you must notify us as soon as possible.

If you instruct your own solicitor or accountant without telling ARAG, you will be liable for costs that are not covered by your policy.

You must:

  • tell ARAG immediately of anything that may make it more costly or difficult for the appointed advisor to resolve the claim in your favour
  • cooperate fully with ARAG, give the appointed advisor any instructions ARAG requires, and keep them updated with the progress of the claim and not hinder them
  • take reasonable steps to claim back legal costs & expenses and, where recovered, pay them to the insurer
  • allow ARAG at any time to take over and conduct in your name, any claim.
  • agree to us having sight of the appointed advisor’s file relating to your claim. 

When does the cover start and end?

Your cover will start on the date you select and will continue each month until it is cancelled.

How do I cancel the contract?

You can cancel anytime using the cancel option in your customer portal. You can also contact our call center to do it for you. If you cancel within the first 14 days of the cover start date, we promise to issue a full refund.

When and how do I pay?

The premium will be collected from your payment card each month around the same date as your policy start date.

How do I notify a claim?

A claim form can be downloaded at www.arag.co.uk/newclaims or requested by telephoning us on 0330 303 1955 between 9 am and 5 pm on weekdays (except bank holidays).

How do I make a complaint?

To notify us of a complaint, please email gaukcomplaints@gaig.com or call 0117 927 5355 (hours of operation are 8.30 am-5.30 pm, Mondays to Fridays excluding bank holidays. If you are still unsatisfied, we will tell you how to take your complaint to the Financial Ombudsman Service.

Who underwrites this insurance?

This insurance cover is arranged by Suited in conjunction with Great American International Insurance Ltd and administered by ARAG plc, and underwritten by HDI Global Specialty SE (commercial register number: HRB 211924), (FRN: 659331).

Key changes to the policy wording on 1 April 2025

This is a summary of key changes from the previous policy document version. 

Insurer

This insurance is underwritten by DAS Legal Expenses Insurance Company Limited (‘DAS’).

Debt recovery

Debt recovery is still covered but applies for outstanding debt over £500.
